You must be at least 18 years old or have a parent or guardian’s consent, and have the legal authority to enter into this agreement.

These Terms include all additional terms, policies, and guidelines provided by Accessibility for All, which are incorporated here by reference. In case of any inconsistencies between these Terms and other information on our site, these Terms will govern.

Applicability and Acceptance

These Terms apply to all users, regardless of whether the services are free or paid, accessed directly through our website, or via authorized third-party platforms. Certain features may only be available under separate agreements.

By accessing or using our platform, you confirm that you have read, understood, and agreed to these Terms, along with our Privacy Policy.

License Grant and Use Restrictions

Accessibility for All grants you a limited, non-exclusive, non-transferable, non-sublicensable license to install and use our products solely on the specified licensed website. Each license applies to one domain unless specified otherwise in your Purchase Order. This license does not transfer ownership rights of the products to you, and the license cannot be extended to any other domain or website without purchasing an additional license.

You are strictly prohibited from:

  1. Sharing of your credentials, licenses, or access with third parties who are not paying users.
  2. Using products and services beyond the scope outlined in these Terms.
  3. Sublicensing, distributing, or making the service available for unauthorized commercial purposes without prior written consent.

Violation Consequences: if unauthorized sharing or misuse of licenses is detected, your access will be immerdiately terminated without a refund.

Account Registration and Responsibilities

To access certain services, you must register for an account. By registering, you agree to:

  1. Provide accurate and up-to-date information.
  2. Maintain the confidentiality of your account credentials.
  3. Notify us immediately of any unauthorized use.

We reserve the right, at our sole discretion, to suspend or terminate accounts that violate these Terms or pose security risks.

  • Dirupt or interfere with the functionality of our platform.
  • Misrepresent your affiliation with Accessibility for All.
  • Circumvent security measures or exploit the platform’s vulneraabilities.

Failure to comply with these restrictions may result in termination of access and potential legal action.

Intellectual Property Rights

All rights in and to the Accessibledocs platform and services, including any documentation, logos, content, or software, are proprietary to Accessibility for All and its licensors. You agree not to, and not to allow any third party to: (i) sublicense, distribute, or use the services outside the scope of these Terms; (ii) copy, modify, adapt, or create derivative works; (iii) reverse engineer, decompile, disassemble or attempt to discover the source code, except as expressly permitted by law; or (iv) use our trademarks, service marks, or other proprietary content without written permission.

Support and Service Limitations

Accessibility for All strives to ensure compliance with WCAG 2.1 Level AA criteria but does not gurantee uninterrupted or error-free service. We offer support during business hours via email, chat, and video conferencing, dependent on the severity of the issue and subject to applicable support fees.

Payments

These Terms, together with the Purchase, are the complete and binding agreement between you and Accessibility for All regarding your license and services. You authorize Accessibility for All to process the payment. Payments are processed through secure third-party providers which may be added and or changed in our sole discretion. Subscriptions renew automatically unless canceled. Accessibility for All is not responsible for transaction, overdraft, over-limit, or non-sufficient fund fees.

Cancellation Policy

You may cancel the Transaction in accordance with the Consumer Protection Regulations (Cancellation of Transaction), 2010, and the Consumer Protection Law, 1981. Cansellation may result in losing th efeatures odf your account. Accessibility for All is not liable for such loss.

Refund Policy

If you are unsatisfied with our services, you may cancel within 14 days from the subscription start date for a refund. Refund requests should be submitted to [support email] and must include your full name, domain name for the canceled service, and proof of purchase. Refunds after 14 days are not available, and certain fees may apply as allowed by law.

Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless Accessibility for All, its affiliates, officers, directors, employees, and representatives from any claims, damages, or expenses arising from your breach of these Terms, your use of the services, and any violation of applicable laws. Additionaly, please note that Accessibledocs  platform is currnetly in beta, and we do not accept responsibility for the quality of services or outcomes. It is hereby clarified that the indemnification obligations will survive these Terms.

Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE PLATFORM, SERVICES, WIDGETS, REPORTS, AND RELATED CONTENT ARE PROVIDED “AS IS,” “WITH ALL FAULTS,” AND “AS AVAILABLE.” ACCESSIBILITY FOR ALL, INCLUDING ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SUPPLIERS (COLLECTIVELY, “ACCESSIBILITY FOR ALL REPRESENTATIVES”), DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. THIS INCLUDES, BUT IS NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ARISING FROM ANY COURSE OF DEALING OR TRADE USAGE.

PLEASE NOTE THAT ADDITIONAL CONSUMER RIGHTS UNDER YOUR LOCAL LAWS MAY REMAIN UNAFFECTED BY THIS AGREEMENT. ANY WARRANTIES OR OBLIGATIONS RELATED TO SERVICES PROVIDED UNDER SEPARATE AGREEMENTS SHALL BE GOVERNED SOLELY BY THE TERMS OF THOSE AGREEMENTS.

WE DO NOT GUARANTEE THAT:

  1. THE SITE, SERVICES, WIDGETS, REPORTS, OR CONTENT WILL BE SECURE, TIMELY, UNINTERRUPTED, ACCURATE, COMPLETE, OR FREE FROM DEFECTS, VIRUSES, OR HARMFUL COMPONENTS.
  2. ERRORS OR DEFECTS IN THE SITE, SERVICES, WIDGETS, OR CONTENT WILL BE CORRECTED.
  3. THE RESULTS OBTAINED FROM USING THE SITE, SERVICES, OR WIDGETS WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS.

ACCESSIBILITY FOR ALL AND ITS REPRESENTATIVES DISCLAIM ALL LIABILITY FOR ANY DAMAGE, ERROR, OR LOSS RESULTING FROM:

  • INACCURACIES OR ISSUES WITHIN THE SITE, SERVICES, WIDGETS, REPORTS, OR CONTENT.
  • ANY RELIANCE PLACED ON THE INFORMATION PROVIDED.
  • THIRD-PARTY SERVICES OR ITEMS INTEGRATED INTO THE PLATFORM.

WE ARE NOT LIABLE FOR ISSUES ARISING FROM TECHNICAL PROBLEMS, INCLUDING BUT NOT LIMITED TO SLOW INTERNET CONNECTIONS, SERVER OVERLOADS, OR DISRUPTIONS FROM INTERNET OR TELECOMMUNICATIONS PROVIDERS. YOUR USE OF THE SITE, SERVICES, WIDGETS, REPORTS, AND CONTENT IS ENTIRELY AT YOUR OWN RISK.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ACCESSIBILITY FOR ALL, INCLUDING ITS AFFILIATES, REPRESENTATIVES, AND EMPLOYEES, SHALL NOT BE HELD LIABLE FOR ANY FORM OF DAMAGES. THIS INCLUDES, BUT IS NOT LIMITED TO, DIRECT, INDIRECT, SPECIAL, PUNITIVE, EXEMPLARY, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND. SUCH DAMAGES MAY INCLUDE, WITHOUT LIMITATION, LOSS OF GOODWILL, PROFITS, DATA, OR BUSINESS INTERRUPTIONS, ARISING FROM OR RELATED TO:

  1. THE USE OR INABILITY TO USE THE PLATFORM, SERVICES, WIDGETS, REPORTS, OR CONTENT.
  2. ANY INTERACTIONS OR COMMUNICATIONS WITH OTHER USERS OR THIRD PARTIES THROUGH THE PLATFORM OR SERVICES.
  3. ANY FAILURE OF THE PLATFORM, SERVICES, WIDGETS, REPORTS, OR CONTENT TO MEET EXPECTATIONS OR PERFORM AS REPRESENTED.
  4. BREACHES OF WARRANTY, GUARANTEES, CONTRACTS, OR OBLIGATIONS UNDER ANY LEGAL THEORY, INCLUDING NEGLIGENCE, STRICT LIABILITY, OR TORT, REGARDLESS OF WHETHER ACCESSIBILITY FOR ALL HAS BEEN ADVISED OF THE POTENTIAL FOR SUCH DAMAGES.

IN ANY CASE, AND TO THE MAXIMUM EXTENT LEGALLY PERMISSIBLE, THE TOTAL CUMULATIVE LIABILITY OF ACCESSIBILITY FOR ALL AND ITS REPRESENTATIVES FOR ALL CLAIMS, LOSSES, OR DAMAGES RELATED TO YOUR USE OF THE PLATFORM, SERVICES, WIDGETS, OR CONTENT SHALL NOT EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THESE SERVICES IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

YOU EXPLICITLY WAIVE ANY RIGHTS TO RECOVER ADDITIONAL DAMAGES, SUCH AS LOST PROFITS OR INCIDENTAL, INDIRECT, OR SPECIAL DAMAGES. IN JURISDICTIONS WHERE SUCH LIMITATIONS ARE RESTRICTED BY LAW, THE EXCLUSIONS AND LIMITATIONS SET FORTH HEREIN WILL APPLY TO THE FULLEST EXTENT PERMITTED.

Privacy

Your use of our services constitutes your agreement to our Privacy Policy. You are responsible for compliance with all data privacy laws applicable in your jurisdiction, including proper handling of personal information.

Termination and Blocking of Access

Accessibility for All reserves the right to suspend or terminate your access to the platform, without a notice, if any term of this agreement is violated, particularly if unauthorized sharing of access credentials or licenses is detected. This action will protect the integrity of our services and ensure compliance with these Terms. Upon termination, your rights to use the services cease immediately.

Changes to Terms

Accessibility for All reserves the right to modify these Terms of Use at any time. Your continued use of the services after any modifications signifies your acceptance of the updated Terms.
